SC directs Union Government to submit NGOs’ audit report by March 2017
The Supreme Court (SC) on 10 January 2017 directed the Union Government and the Council for Advancement of People’s Action and Rural Technology (CAPART) to complete auditing of NGOs (Non-Governmental Organisation) and voluntary organisations and submit its report by 31 March 2017.
● The ruling was made by a bench of Chief Justice JS Khehar and justices NV Ramana and DY Chandrachud. The court rebuked the government over its failure to work out a regulatory mechanism to monitor the public money that is given to the 32 lakh NGOs, societies and voluntary organisations in the country.
● The bench ruled that 'mere blacklisting' of these organisations cannot be sufficient. Moreover, civil and criminal action should be initiated against these organisations for misappropriation of public money received by them from the centre.
● The government was also directed to explain the manner in which it will maintain the accounts, conduct the audit, the process of recovery and methodology of recovery of the amount in case of misappropriation and criminal proceedings.
● It directed the competent authority to come out with guidelines for a regulatory mechanism by March 2017. The bench also asked whether General Financial Rules 2005 were complied with or not as the Rules 210-212 provide for a regulation mechanism for NGOs.
सुप्रीम कोर्ट ने 31 मार्च 2017 तक केंद्र सरकार से सभी एनजीओ के आडिट कर कोर्ट मे रिपोर्ट पेश करने का निर्देश दिया है. ये आदेश मुख्य न्यायाधीश जेएस खेहर की अध्यक्षता वाली तीन सदस्यीय पीठ ने एनजीओ के फंड में घपले का आरोप लगाने वाली वकील एमएल शर्मा की याचिका पर दिये.
● सुप्रीम कोर्ट ने कहा है कि जो एनजीओ फंड के दुरुपयोग के दोषी पाए जाएं उनके खिलाफ आपराधिक एवं दीवानी कार्यवाही की जाए. सुप्रीम कोर्ट में दाखिल की गई रिपोर्ट के अनुसार देश भर मे लगभग 32 लाख 97 हजार एनजीओ हैं जिसमें से सिर्फ 3 लाख 7000 ने ही अपने खर्च का लेखाजोखा सरकार को दिया है.
● कोर्ट ने कहा कि केंद्र सरकार और उसके विभागों के बीच एनजीओ की आडिटिंग (लेखाजोखा) को लेकर तथा वित्त मंत्रालय द्वारा जारी जनरल फाइनेंशियल नियम 2005 को लागू करने के बारे में भ्रम है.
● कोर्ट ने ग्रामीण विकास मंत्रालय एवं कपार्ट तथा अन्य जिम्मेदार एजेंसियों को आदेश दिया है कि वे 31 मार्च 2017 तक नियमों के अनुसार सभी एनजीओ का आडिट पूरा कर के सुप्रीम कोर्ट में रिपोर्ट दाखिल की जाए.
● कोर्ट ने सरकार से कहा है कि वह एनजीओ को नियमित करने उनकी मान्यता और उन्हें फंड जारी करने से लेकर हिसाब किताब लेने तक के दिशा निर्देश तय करे.
● सुप्रीम कोर्ट ने कहा कि जो एनजीओ बैलेंस शीट देकर अपना लेखाजोखा नहीं दें रहे है उनके खिलाफ वसूली के लिए सिविल और दीवानी कार्रवाई हो.
● पीठ ने इस बारे में केंद्र सरकार को हलफनामा दाखिल करने का दिशा निर्देश दिया है साथ ही यह भी कहा है कि हलफनामा दाखिल करने वाला अधिकारी आइएएस अधिकारी होना चाहिए जो कि संयुक्त सचिव स्तर से नीचे का नहीं होगा साथ ही हलफनामा विभाग के सचिव से मंजूर होना चाहिए.
