New Benami Act to take effect from Nov 1
The new law to prohibit benami transactions, which also provides for up to 7 years imprisonment and penalty for those indulging in such activities, will come into effect from November 1.
● With a view to curb the menace of black money, Parliament in August had passed the Benami Transactions (Prohibition) Act after assurance from Finance Minister Arun Jaitley that genuine religious trusts will be kept out of the purview of the legislation.
● While the existing law provides for up to three years of imprisonment or fine or both for carrying out benami transactions, the amended legislation would provide for seven years imprisonment and fine.
● The Act defines benami transactions, prohibits them and further provides that any violation is punishable with imprisonment and fine.
● The PBPT Act prohibits recovery of the property held benami from benamidar by the real owner.
एक नवंबर के बाद कोई बेनामी लेनदेन नहीं किया जा सकेगा। अगर कोई व्यक्ति बेनामी लेनदेन करने या बेनामी संपत्ति खरीदने का दोषी पाया जाएगा तो उसे सात साल तक की सजा हो सकती है और जुर्माना लगाया जा सकता है। ये प्रावधान एक नवंबर से लागू हो रहे बेनामी प्रॉपर्टी एक्ट में किये गये हैं।
● काले धन की समस्या से निपटने के लिए संसद ने अगस्त में बेनामी ट्रांजेक्शन (प्रोहिबिशन) एक्ट पास किया था। हालांकि इस एक्ट को मंजूरी मिलने से पहले वित्त मंत्री अरुण जेटली ने आश्वासन दिया था कि वास्तविक धार्मिक ट्रस्ट को इस कानून के दायरे से बाहर रखा जाएगा।
● केंद्रीय प्रत्यक्ष कर बोर्ड (सीबीडीटी) ने एक बयान में कहा कि बेनामी ट्रांजेक्शन (प्रोहिबिशन) एक्ट के सभी नियम और प्रावधान एक नवंबर से प्रभावी हो जाएंगे।
● मौजूदा कानून में बेनामी लेनदेन का दोषी पाये जाने पर तीन साल तक की सजा या जुर्माना अथवा दोनों का प्रावधान है जबकि नए कानून में सात साल की सजा और जुर्माने की व्यवस्था है।
● इस कानून में बेनामीदार के नाम पर दर्ज संपत्ति वास्तविक मालिक द्वारा प्राप्त किये जाने पर भी प्रतिबंध है। सीबीडीटी का कहना है कि बेनामी संपत्तियां सरकार कोई मुआवजा दिये बगैर जब्त कर सकती है। इस कानून में अपीलीय तंत्र की भी व्यवस्था की गई है।
