HIV and AIDS Bill Amendments Approved
The Union Cabinet on 5 October 2016 approved the amendments to the HIV and AIDS (Prevention and Control) Bill, 2014.
● The HIV and AIDS Bill, 2014 was drafted to safeguard the rights of people living with HIV and affected by HIV.
● It seeks to address HIV-related discrimination, strengthen the existing programme by bringing in legal accountability and establish formal mechanisms for inquiring into complaints and redressing grievances.
● It seeks to prevent and control the spread of HIV and AIDS, prohibits discrimination against persons with HIV and AIDS.
● It seeks to provide for informed consent and confidentiality with regard to their treatment, places obligations on establishments to safeguard rights of persons living with HIV.
● It aims to enhance access to health care services by ensuring informed consent and confidentiality for HIV-related testing, treatment and clinical research.
केंद्रीय मंत्रिमंडल ने पांच अक्तूबर 2016 को ‘एचआईवी एवं एड्स विधेयक, 2014’ को मंजूरी दे दी. केंद्रीय स्वास्थ्य मंत्री जे पी नड्डा के अनुसार विधेयक में राज्य और केंद्र सरकार एंटीरेट्रोवाइरल थेरेपी (एआरटी) प्रदान करना अनिवार्य बनाया गया है.
● एचआईवी एवं एड्स विधेयक, 2014 के तहत एचआईवी आौर एड्स से पीड़ित मरीजों के साथ भेदभाव करने वाले व्यक्ति को अपराधी मानकर उसके खिलाफ अधिकतम दो साल की जेल और एक लाख रुपये जुर्माने का प्रावधान किया गया है.
● सरकार ने इस संबंध में कानून में संशोधनों को मंजूरी दे दी. मसौदा कानून के माध्यम से ऐसे लोगों के साथ भेदभाव करने वालों के विरुद्ध शिकायतों की जांच हेतु एक औपचारिक तंत्र स्थापित करने और कानूनी जवाबदेही सुनिश्चित करने का प्रावधान करके एड्स मरीजों और एचआईवी विषाणु से संक्रमित लोगों के हितों की रक्षा करने की कोशिश की है.
● विधेयक में भेदभाव के तरीकों को भी सूचीबद्ध किया गया है.
● विधेयक में भेदभाव के तरीकों को प्रतिबंधित भी किया गया है.
● भेदभाव के तरीकों में रोजगार, शैक्षणिक संस्थानों, स्वास्थ्य देखभाल सेवाओं, निवास के लिए या किराए पर दी गई संपत्तियों समेत अन्य के संबंध में अस्वीकृति, समाप्ति या अनुचित व्यवहार शामिल है.
