Gujarat HC quashes state government notification for EBC quota
Gujarat high court on 4 August 2016 quashed the state government's notification granting 10 percent reservation for the economically backward classes (EBCs).
• The Court termed the notification as unconstitutional, which was issued by Anandiben Patel Government on 1 May 2016 granting 10 percent quota for EBCs in higher educational institutions and government jobs.
• Earlier, the High court issued notices in response to a petition filed by a Rajkot-based writer and social worker, Jayantibhai Manani.
• The petitioner had asked the high court that on the occasion of the foundation day of Gujarat unreserved economically backward classes Notification, 2016, non-reserved who belongs to the class of people who were provided 10 percent reservation & whose annual family income does not exceed Rs six lakh. The ordinance should be dismissed.
• State Government spokesperson Nitin Patel has said that Government will challenge this order in the Supreme Court.
गुजरात उच्च न्यायालय ने गुजरात सरकार द्वारा शिक्षण संस्थानों में ईबीसी (आर्थिक रूप से पिछड़े वर्ग) के लिए 10 प्रतिशत आरक्षण दिए वाली अधिसूचना को गुजरात हाईकोर्ट ने 4 अगस्त 2016 को खारिज कर दिया.
• वर्ष 2017 में होने वाले विधानसभा चुनावों को मद्देनजर रखते हुए आनंदीबेन पटेल सरकार ने उच्च शिक्षा और सरकारी नौकरियों में ईबीसी के लिए 10 प्रतिशत का कोटा देने के लिए 1 मई 2016 को एक नोटिफिकेशन जारी किया था.
• राजकोट के लेखक और सामाजिक कार्यकर्ता, जयंतीभाई मनानी द्वारा दायर की गई याचिका पर अदालत ने प्रतिक्रिया देते हुए एक नोटिस जारी किया था.
• याचिकाकर्ता ने उच्च न्यायालय से आग्रह किया था कि राज्य के स्थापना दिवस के अवसर पर जारी गुजरात गैर-आरक्षित आर्थिक रूप से पिछड़ा वर्ग अधिसूचना, 2016 गैर-आरक्षित वर्ग से ताल्लुक रखने वाले ऐसे लोगों को 10 प्रतिशत आरक्षण देने का प्रावधान था जिनके परिवार की वार्षिक आय छह लाख रुपये से अधिक न हो. इस अध्यादेश को खारिज किया जाए.
• नितिन पटेल ने कहा है कि सरकार सुप्रीम कोर्ट में इस आदेश को चुनौती देंगे।
