GST Dual Control Meet remains inconclusive - Meet again on Nov 25
After nailing a four-tier rate structure of 5, 12, 18 and 28 per cent, the GST Council yet again on Friday failed to arrive at a consensus over which category of assessees should be governed by the Centre and which by states, a disagreement that threatens to derail the April 1 target for rollout of the new indirect tax regime.
● Jaitley, who had previously stated that he hoped for all modalities for the GST to be finalised by November 22, was still hopeful of getting the supporting legislations during the ensuing Winter Session of Parliament from November 16.
● Differences on the issue of cross empowerment to avoid dual control arose with states demanding control over 11 lakh service tax assessees, and Centre proposing to do away states having exclusive control over all dealers up to an annual revenue threshold of `1.5 crore -- an issue which was settled in the first meeting of the GST Council.
● The GST Council meetings, earlier called for November 9 and 10, have been scheduled to meet on November 24 and 25.
● Speaking on the draft CGST , SGST and IGST legislations, the minister said, Jaitley said it will be sent to states after November 15 and the GST Council in November 24-25 meeting will approve them.
अप्रत्यक्ष करों के क्षेत्र में प्रस्तावित नई वस्तु एवं सेवाकर (जीएसटी) प्रणाली के तहत 5, 12, 18 और 28 प्रतिशत की चार स्तरीय कर व्यवस्था रखे जाने का निर्णय के बाद केंद्र सरकार भले ही एक अप्रैल, 2017 से वस्तु एवं सेवा कर (जीएसटी) लागू करने की कोशिश कर रही है। लेकिन जीएसटी असेसी (करदाताओं) पर प्रशासनिक नियंत्रण को लेकर केंद्र और राज्यों के बीच गतिरोध बरकरार है।
● वित्त मंत्री अरुण जेटली की अध्यक्षता में रविवार को राज्यों के वित्त मंत्रियों की अनौपचारिक बैठक में भी इसका कोई हल नहीं निकला।
● अब सबकी नजरें 25 नवंबर को होने वाली जीएसटी काउंसिल की बैठक पर टिकी हैं। माना जा रहा है कि इस बैठक में शायद इस विवादित मुद्दे पर कोई सहमति बन जाए।
● जीएसटी लागू होने पर केंद्र सरकार के सेवा कर, केंद्रीय उत्पाद शुल्क और राज्यों के वैट जैसे परोक्ष कर समाप्त हो जाएंगे।
● राज्य जीएसटी लागू होने पर 1.5 करोड़ रुपये सालाना कारोबार वाले असेसी पर उनके पूर्ण नियंत्रण के फार्मूला पर शायद राजी हो गए हैं।
● लेकिन जीएसटी काउंसिल की पिछली बैठक में इस मुद्दे पर असहमति सामने आ गई। लगभग तीन घंटे चली बैठक के बाद वित्त मंत्री ने संवाददाताओं से कहा कि बैठक अधूरी रही।
● इस मुद्दे पर विचार 25 नवंबर को होने वाली बैठक में भी होगा।
● वित्त मंत्री पहले ही स्पष्ट कर चुके हैं कि जीएसटी को 16 सितंबर, 2017 से पहले लागू करना होगा। उल्लेखनीय है कि पश्चिम बंगाल, केरल, उत्तराखंड, उत्तर प्रदेश और तमिलनाडु ने सालाना 1.5 करोड़ रुपये के कारोबार वाले कारोबारियों को राज्यों के अधीन रखने की मांग की है।
