Adoption Regulations, 2017 came into force on 16 January
Adoption Regulations, 2017 becomes operational on 16 January 2017.
● The new set of regulations seeks to further strengthen the adoption programme in the country by replacing the Guidelines Governing Adoption of Children 2015.
● They were notified by the Union Ministry of Women and Child Development.
● The regulations are in tune with the Hague Adoption Convention to which India is a signatory.
● Any orphan or abandoned or surrendered child, who is declared legally free for adoption by the Child Welfare Committee is eligible for adoption.
● The prospective adoptive parents shall be physically, mentally and emotionally stable, financially capable and shall not have any life threatening medical condition.
● No child shall be given in adoption to a couple unless they have at least two years of stable marital relationship.
दत्तक ग्रहण विनियम 2017 भारत में 16 जनवरी 2017 से लागू हो गया.
● नियमों के नए सेट वर्ष 2015 के दत्तक ग्रहण कार्यक्रम का स्थान लेंगे तथा इससे देश में गोद लेने की प्रक्रिया को मजबूत बनाया जायेगा.
● इन्हें केन्द्रीय महिला एवं बाल विकास मंत्रालय द्वारा अधिसूचित किया गया.
● यह नियम भारत द्वारा हस्ताक्षरित हेग कन्वेंशन दत्तक ग्रहण नियमों के अनुरूप हैं.
● हेग दत्तक ग्रहण अभिसमय से बालक संरक्षण और अंतर-देशीय दत्तक ग्रहण की बाबत सहयोग पर हेग अभिसमय अभिप्रेरित है.
● कोई भी अनाथ या परितक्यत या अभ्यर्पित बालक और बाल कल्याण समिति द्वारा दत्तकग्रहण के लिए स्वतंत्र घोषित किया गया बालक दत्तक ग्रहण के लिए पात्र बालक है.
● भावी दत्तक माता-पिता को शारीरिक, मानसिक और भावनात्मक रूप से दृढ़, वित्तीय रूप से सक्षम होना चाहिए और उनकी जीवन को जोखिम में डालने वाली चिकित्सा दशा नहीं होनी चाहिए.
● विवाहित दंपत्ति की दशा में दत्तकग्रहण पति-पत्नी दोनों की सहमति आवश्यक है.
● अविवाहित एकल स्त्री किसी भी लिंग के बालक के दत्तकग्रहण के लिए स्वतंत्र है.
● एकल पुरुष अथवा अविवाहित पुरुष किसी बालिका के दत्तक ग्रहण के लिए पात्र नहीं है.
