NATIONAL:
Lok Sabha gives nod to legislation that bans commercial surrogacy.
• Lok Sabha passed the Surrogacy (Regulation) Bill, 2019, which seeks to ban commercial surrogacy and allows only close relatives of infertile couples to volunteer for “ethical altruistic" reasons.
The bill and it is unfortunate that the country had emerged as a hub of commercial surrogacy in recent years. During the discussion on the bill.There are 2,000-3000 surrogacy clinics running illegally in India and a few thousand foreign couples resort to surrogacy practice within India, and the whole issue is thoroughly unregulated.
The concerning unethical practices, abandonment of children born out of surrogacy and exploitation of surrogate mothers.The minister cited the 228th report of the Law Commission recommended that the government enact a legislation to ensure that commercial surrogacy is banned in this country and there is only restrictive surrogacy.
Surrogacy (Regulation) Bill, 2019,
The bill also aims to constitute surrogacy boards at the national and state levels. The bill aims to allow ethical altruistic surrogacy for infertile Indian married couples, within the age group of 23-50 and 26-55 years for females and males, respectively. The bill, which was passed by a voice vote, also prohibits the sale and purchase of human embryos and gametes. The government has claimed that it will also prevent exploitation of surrogate mothers and children born through surrogacy.India emerged as a commercial destination for foreigners seeking surrogate mothers. There have been reports on unethical practices, exploitation of surrogate mothers, abandonment of children born out of surrogacy, and rackets involving intermediaries importing human embryos and gametes.Women’s rights activists have supported the passage of the bill.
Rajasthan passed bill against anti lynching.
• The Rajasthan State Legislative Assembly passed the Rajasthan Protection from Lynching Bill, 2019. The Parliamentary Affairs Minister Shanti Dhariwal introduced the Bill in the State Assembly. The Bill aims to provide stricter punishment to curb such Lynching incidents.
• Rajasthan is now the second State to have a dedicated law criminalising mob lynching as a special offence. The first state to have such law in addition to other offences under the Indian Penal Code (IPC) is Manipur.
• SC's recommendation:
• The Bill was introduced after the recommendation by the Supreme Court in authorising the setting up of special courts, appointment of a dedicated nodal officer, and stipulating enhanced punishments.
• The bill not only criminalises the acts of lynching but also provides legal aid, relief, compensation and rehabilitation.
• Definition of Lynching as per the Bill:
• Any act or series of acts of violence whether spontaneous or planned, by a mob on the grounds of religion, race, caste, sex, place of birth, language, dietary practices, sexual orientation, political affiliation and ethnicity falls under the category Lynching.
• Provisions of the Bill:
• ♦ Bill makes the Mob Lynching offence cognizable, non-bailable and non-compoundable offences.
• ♦ It gives a punishment of life imprisonment and a penalty from Rs.1 lakh to Rs.5 lakh to those convicted in cases of mob lynching leading to victim's death.
• ♦ After 2014, 86% of mob lynching cases that were reported in the country are from Rajasthan. The Bill was proposed after considering peace in the state.
RS passed Jammu and Kashmir Reorganisation Bill.
• The Rajya Sabha cleared the Jammu and Kashmir Reorganisation Bill 2019 on 6 August. Union Home Minister Amit Shah presented the Bill after abrogation of the special status granted to J&K. The upper house also adopted resolutions to repeal Article 370 and Article 35A in J&K.
The Bill has been moved for consideration and passage in Lok Sabha on August 6, 2019. The lower house will also take up the Jammu and Kashmir Reservation Bill 2019.
Provisions of the Bill:
♦ The Bill proposed the bifurcation of the state of Jammu and Kashmir into two Union Territories namely Ladakh and Jammu-Kashmir.
♦ The bill has a provision of 10% reservation for Economically Weaker Sections (EWS) among the general category (the upper caste).
Lok Sabha passes Transgender Persons Bill.
• The Lok Sabha on Monday passed the Transgender Persons (Protection of Rights) Bill, 2019 which aims for social, economic and educational empowerment of transgender persons, by a voice vote. The bill has scrapped provisions that criminalise begging by transgenders. As per the bill, a transgender is someone whose gender doesn't match with the gender assigned at birth.

सरोगेसी विधेयक लोकसभा में पास,
• लोकसभा में 5 अगस्त को सरोगेसी (किराए की कोख) से जुड़ा एक बिल पास किया जिसके मुताबिक कमर्शियल सरोगेसी (Surrogacy) पर बैन लगा दिया है. स्वास्थ्य मंत्री हर्षवर्धन ने बताया कि पूरे भारत में 2 से 3 हज़ार गैर-कानूनी सरोगेसी सेंटर चल रहे हैं. इन सेंटर्स में हज़ारों विदेशी कपल भारत आते हैं और सरोगेसी करवाते हैं और ये पूरी प्रक्रिया अनियमित है.
हर्षवर्धन ने आगे बताया कमर्शियल सरोगेसी (Commercial Surrogacy) लगभग सभी देशों में बैन हो चुकी है और अब बारी भारत की है. उन्होंने बताया कि न्यूजीलैंड, ऑस्ट्रेलिया, जापान, ब्रिटेन, जापान, फिलीपीन, स्पेन, स्विट्जरलैंड और जर्मनी समेत अनेक देशों में व्यावसायिक सरोगेसी अवैध है.
कमर्शियल सरोगेसी सिर्फ यूक्रेन, रूस और अमेरिका के कैलीफोर्निया में ही फिलहाल वैध है.
उन्होंने आगे बताया कि रिपोर्ट्स बताती हैं कि सरोगेसी से हुए बच्चों का परित्याग किया जाता है और सरोगेट मांओ के साथ भी शोषण किया जाता है.
इस बिल में कहा गया कि इन्फर्टाइल कपल (Infertile Couples) सिर्फ अपने करीबी रिश्तेदारों से ही सरोगेट करवा सकते हैं. इस बिल में आगे यह भी कहा गया कि कमर्शियल सरोगेसी करने वाले लैब्स, क्लीनिक या फिर विज्ञापन देने वालों पर 10 साल की जेल और 10 लाख का जुर्माना हो सकता है.
बिल में बताया गया कि सरोगेसी सिर्फ वही शादीशुदा जोड़े करा सकते हैं जिनकी शादी साल 2015 के बाद हुई है. इतना ही नहीं जोड़ों की उम्र 23 से 55 साल के बीच होनी चाहिए.
क्या होती है सरोगेसी?
जो लोग खुद की संतान चाहते है और बार-बार गर्भपात होने की स्थिति या आईवीएफ के फेल होने की वजह से संतान सुख से वंचित रह जाते हैं सरोगेसी उन लोगों के बीच काफी लोकप्रिय है. इस प्रक्रिया में पुरुष के स्पर्म को एक स्वस्थ महिला के गर्भ में 9 महीनों तक रखा जाता है, जिसके बाद महिला संतान के जन्म के बाद उसे निसंतान दंपति को सौंप देती है.
राजस्थान: मॉब लिंचिंग की रोकथाम के लिए विधेयक पारित, कड़ी सजा का प्रावधान
• भीड़ की हिंसा और लोगों को पीट पीटकर मारने की घटनाओं के खिलाफ राजस्थान सरकार ने कड़ा कानून बनाया है. मॉब लिंचिंग करने वालों और भीड़ में शामिल होकर लिंचिंग में सहयोग करने वालों अब कड़ी सजा मिलेगी. राजस्थान लिंचिंग से संरक्षण विधेयक को विधानसभा में पारित किया गया है. हालांकि विधेयक को पारित करवाने के लिए सदन में सदस्यों को खड़ा करवा कर उनकी गिनती की गई और उसके बाद बहुमत के आधार पर इसे पारित किया गया.
• मॉब लिंचिंग में मौत होने पर अब दोषियों को आजीवन कठोर कारावास और एक से पांच लाख तक का जुर्माने का दंड होगा. लिचिंग में पीड़ित को घायल करने वालों को सात साल तक की सजा, एक लाख रुपए तक का जुर्माने का प्रावधान विधेयक में किया है. लिचिंग में पीड़ित के गंभीर रूप से घायल होने पर 10 साल तक की कैद और 50 हजार से 3 लाख तक का जुर्माना होगा.
• लिचिंग में किसी भी रूप से सहायता करने वाले को भी वही सजा मिलेगी जो खुद लिचिंग करने पर है. मॉब लिंचिंग के मामलों की जांच इंस्पेक्टर स्तर या उससे उपर का पुलिस अफसर ही करेगा, इससे नीचे के स्तर का अफसर जांच नहीं कर सकेगा. विधेयक में प्रावधान है कि लिंचिंग में किसी भी रूप से सहायता करने वाले को भी वहीं सजा मिलेगी जो खुद लिचिंग करने पर है.
राज्यसभा में भी पास हुआ जम्मू-कश्मीर पुनर्गठन बिल,
• जम्मू-कश्मीर राज्य को 2 केंद्रशासित प्रदेशों- जम्मू-कश्मीर और लद्दाख में बांटे जाने संबंधी जम्मू-कश्मीर पुनर्गठन विधेयक को राज्यसभा की मंजूरी मिलने के एक दिन बाद लोकसभा की भी मंजूरी मिल गई। राष्ट्रपति के हस्ताक्षर के बाद यह बिल कानून का रूप ले लेगा। इसके अलावा जम्मू-कश्मीर को विशेष दर्जा देने संबंधी आर्टिकल 370 के प्रावधानों को हटाने का प्रस्ताव भी पास हो गया। आर्टिकल 370 के तहत जम्मू-कश्मीर के स्पेशल स्टेटस को खत्म करने का प्रस्ताव लोकसभा में 72 के मुकाबले 351 मतों से स्वीकार किया गया जबकि एक सदस्य अनुपस्थित रहे। वहीं, राज्य को दो केंद्र शासित प्रदेशों में पुनर्गठित करने वाला बिल 70 के मुकाबले 370 वोटों से पारित हो गया।
लोकसभा ने ट्रांसजेंडर व्यक्ति (अधिकारों की सुरक्षा) विधेयक को मंजूरी दी
• लोकसभा ने सोमवार को उभयलिंगी या ट्रांसजेंडर व्यक्ति (अधिकारों की सुरक्षा) विधेयक 2019 को मंजूरी दी जिसके माध्यम से ट्रांसजेंडर व्यक्तियों को समाज की मुख्यधारा में लाने और उनके विभिन्न अधिकारों की रक्षा करने का उपबंध किया गया है । निचले सदन में विधेयक पर चर्चा का जवाब देते हुए सामाजिक न्याय एवं अधिकारिता राज्य मंत्री रतनलाल कटारिया ने कहा कि विधेयक में संसद की स्थायी समिति की ज्यादातर सिफारिशों को शामिल किया गया है। उन्होंने कहा कि इस विधेयक के पारित होने से ट्रांसजेंडर समुदाय के हितों की रक्षा होगी। मंत्री ने कहा कि इस वर्ग के लिए शिक्षा के अधिकार, स्वास्थ्य के अधिकार और उनके कल्याण को लेकर कई कदम उठाए जा रहे हैं। कटारिया ने कहा कि ट्रांसजेंडर लोगों के खिलाफ अपराध करने वालों के लिए दंड का प्रावधान किया गया है। उन्होंने कहा कि विधेयक में, ट्रांसजेंडर लोगों के हितों की रक्षा के लिए राष्ट्रीय परिषद की स्थापना करने की व्यवस्था की गई है। मंत्री के जवाब के बाद सदन ने विपक्ष के कुछ संशोधनों को खारिज करते हुए ध्वनिमत से विधेयक को मंजूरी दे दी । इस विधेयक में ट्रांसजेंडर व्यक्तियों के सामाजिक, आर्थिक और शैक्षिक सशक्तिकरण के लिए एक कार्य प्रणाली उपलब्ध कराने का प्रावधान किया गया है । केंद्रीय मंत्रिमंडल ने 10 जुलाई को ट्रांसजेंडर व्यक्ति (अधिकारों की सुरक्षा) विधेयक 2019 को मंजूरी दी थी।
